1. Acceptance of Terms

These Terms of Service govern your access to and use of Makecade, including all hosted web games (such as Space Ninja, Invert, Skyward Beat, Battetris, Pixel Fighter, and Arcade Rally Kart 3D), real-time scoreboards, devlogs, game guides, and the AI game creation portal. By accessing the website, you affirm that you are at least 13 years of age and agree to comply with all applicable local, national, and international laws.

2. Fair Play & Global Leaderboard Integrity

Makecade maintains competitive, real-time global scoreboards powered by Google Cloud Firestore. To preserve fair competition and honest recognition for genuine player skill, all players agree to adhere strictly to our Fair Play Code:

• No Cheating or Exploits: You may not use memory scanners (e.g., Cheat Engine), browser script injection, automated speed hacks, botting tools, or network packet manipulation to fabricate or inflate scores.
• Score Validation: Submissions that exceed verified theoretical maximums or that exhibit impossible completion times (e.g., centisecond completion of 5-minute platformer levels) are automatically flagged and expunged from the leaderboards.
• Community Decency in Pseudonyms: Players may choose handles up to 12 characters. Handles containing hate speech, racial slurs, sexual vulgarity, harassment, or defamatory attacks are strictly prohibited and will be permanently wiped.
• API Protection: You agree not to execute automated scripts, scrapers, or DDoS attacks targeting our Cloud Firestore endpoints, Cloudflare Workers, or static Pages origins.

3. Intellectual Property Rights

All creative assets, including without limitation:

• The Makecade platform architecture, user interface code, and brand styling;
• Original game titles: Space Ninja: Storm Striker, Invert, Skyward Beat, Battetris, Pixel Fighter, and Arcade Rally Kart 3D;
• Pixel-art graphics, animation sprite sheets, character designs, and background illustrations;
• Original chiptune soundtracks, sound effect synthesizers, and Web Audio API algorithms;
• Game manuals, strategy guides, devlogs, and editorial articles;

are the proprietary intellectual property of ROSS and Makecade, protected by international copyright, trademark, and unfair competition laws.

Streaming & Content Creation License: You are granted an open, royalty-free license to stream, record, review, and broadcast gameplay footage of Makecade games on video platforms (including YouTube, Twitch, TikTok, and X), provided that you display credit to Makecade and include a link to https://makecade.com/arcade/.

4. Advertising & Third-Party Services

To keep all games 100% free to play without paywalls, subscriptions, or pay-to-win microtransactions, Makecade displays digital advertisements powered by Google AdSense (Publisher ID: ca-pub-5605412363416280). By using the service, you acknowledge that Google and authorized third-party ad networks may place and read cookies as described in our Privacy Policy.

5. Disclaimer of Warranties

Makecade and all associated video games, software, and services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, Makecade disclaims all warranties, express or implied, including but not limited to:

• Uninterrupted, error-free, or zero-latency browser gameplay across every legacy device or operating system;
• Permanent preservation of scoreboard rankings or player data against hardware, database, or network failure;
• Fitness for a particular purpose or non-infringement.

6. Limitation of Liability

Under no legal theory (whether in contract, tort, negligence, or otherwise) shall ROSS, Makecade, or its server hosts be liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to, use of, or inability to use the platform, even if advised of the possibility of such damages.

7. Modifications to Terms

We reserve the right to modify or update these Terms of Service at any time. Changes become effective immediately upon posting to this URL with an updated revision date. Your continued gameplay or browsing after modifications constitute acceptance of the revised terms.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any legal dispute or claim shall be subject to the exclusive jurisdiction of the competent courts located in London, England.
